Kim Kardashian  who allegedly intended to release the footage of her proposal on her reality show, was bested by Co-founder of YouTube Chad Hurley. Now Kim and her fiance Kanye West are suing him for allegedly leaking the video.

In court documents filed Thursday in Los Angeles by the couple, it says that Hurley  “tagged along with someone who was invited” to witness Kanye popping the question, and was only allowed to stay after signing a confidentiality that prohibited him from posting videos or images from that night online.

However the next day the video was leaked on MixBit, a site which Hurley also Co-owns. he also allegedly tweeted it out to his followers and issues a press release on the proposal clip.

The lawsuit apparently states that “Hurley proceeded to try to turn the event into one starring himself, broadcasting the images he knew were the exclusive property rights of someone else,” according to TMZ

Hurley has not returned requests for comment.
